Separation Agreements
Separation Agreements are contracts entered into between married persons with the intent to separate immediately. Separation Agreements often include the identification and ownership of property, alimony and child custody issues. Separation Agreements are commonly referred to as Legal Separation Agreements. Parties will attempt to negotiate a settlement of all issues and then perform under the agreement, including transferring titles and accounts where necessary.
Post-Nuptial Agreements
Post-nuptial Agreements are contracts entered into between married persons for purposes which often include the identification and ownership of property. Importantly, the agreement may dictate the basis for settlement of these marital issues in the event the spouses subsequently divorce, ideally eliminating the necessity for a trial. By statute, post-nuptial Agreements cannot set alimony. In addition, post-nuptial Agreements cannot set child custody or child support.
Legal Custody
When parents split or divorce, they often have questions regarding which parent will make the important decisions regarding their child’s life. Important decisions can include the child's health, education and religious upbringing. Generally, the parent’s ability and authority to make such important decisions will be determined by the type of “Legal Custody” they have. A parent with “Sole Legal Custody” will be able to make the important decisions about their child’s life with little to no input from the other parent. More often, parents split “Legal Custody” and have what is called “Joint Legal Custody.”
Prenuptial Agreements
Increasingly, couples have come to realize the frailty of life and the alarming statistics relating to marriages ending in divorce. More than ever before, men and women are waiting longer before considering marriage, or are embarking on their second or third marriage. Often, they have a career, investments, earnings and separate property to protect. For any person planning to marry, a prenuptial agreement can protect and define their property and future expectations.
